Health status is classed as sensitive personal data under Kenya's Data Protection Act 2019. The part that catches facilities out is registration: organisations processing sensitive personal data, health care among them, are expected to register with the Office of the Data Protection Commissioner even when they fall under the turnover and headcount thresholds that would otherwise exempt a small business.
We want to be straight about the split. Registration, consent, retention and what your staff do with records are yours, and the ODPC is who you deal with. Hosting is the technical layer underneath: encryption in transit, mailbox security, access control and backups. Buying hosting does not make a facility compliant and we will not tell you otherwise.
One more thing worth saying plainly: HIPAA is United States law and does not apply in Kenya. If a vendor sells you "HIPAA compliant" hosting for a Kenyan clinic, they are either copying American marketing or hoping you will not check.
